Abstract
The article is devoted to the development of Penal Law in France influenced by the European Court of Human Rights decisions. France's Council of State – the Supreme Court for administrative justice has also contributed to the French Prison Rules development. The author analyzes the problems of the rights of prisoners, the difficulties of their access to a court, realities of law enforcement in prisons.
