Abstract
This article will examine how the Constitutional Court of the Russian Federation addressed the issue of prejudice in bankruptcy disputes, while also resolving the long-standing doctrinal dispute about the scope of prejudice and the retroactive effect of a Civil Code of the Russian Federation provision allowing for the reduction of usurious interest.
