Problems of Metaverse Legal Regulation

The article studies the legal problems of functioning of metaverses in our country. In particular, the author examine some jurisdiction issues such as the problem of choosing the applicable law to relations in the metaverse. The article also considers the issues of protecting intellectual property in metaverses, provides a description of NFT from the point of view of Russian legislation, explores the relationship between rights to NFT and the exclusive right to an intellectual property fixed in NFT. The author touch upon the problems of “magic circle’ and crimes as well as the issues related to the organization of gambling and advertisement in the metaverse. Drawing on the analysis of prevailing legislation and judicial practice, the author offer conclusions regarding established approaches to regulating metaverses within the national context, highlighting the advantages and disadvantages of each and proposing specific solutions.
