Abstract
The article provides a comprehensive analysis of the institution of independent anticorruption expertise (IAE) as a key element of the Russian anti-corruption system and a form of public control over rule-making. The subject of the study is the legal, organizational, and practical issues that hinder the implementation of the preventive potential of this institution. The aim of the work is to identify the systemic shortcomings of legal regulation and law enforcement practices in the field of IAE, as well as to develop scientifically grounded measures to enhance its effectiveness. Based on an analysis of federal legislation, bylaws, doctrinal sources, official statistics, and law enforcement practice, the authors identify fundamental gaps in the regulation of the status of independent experts, the procedure for taking their opinions into account, and the mechanisms for influencing the rule-making process. Special attention is paid to the problems of the lack of a legal definition of the IAE, formalism in the consideration of expert opinions, low motivation of accredited persons, and underdeveloped institutions of public control. Based on empirical data, it is argued that the persistence of current defects in legal regulation and the imbalance between state and independent expertise hinder the implementation of the preventive potential of the IAE, reducing its role to a declarative one. The article puts forward specific suggestions for enhancing the regulatory framework. These include the codification of the conceptual framework in legislation, the implementation of mechanisms to hold individuals accountable for disregarding expert opinions, the establishment of digital platforms for collaboration, and the development of an incentive system for experts, which will collectively transform the IAE into a truly effective tool for countering corruption.
