Abstract
The article is devoted to the formulation of criteria for jurisdiction in cases of direct judicial review over local regulations and collective agreements. It is argued that the current approaches to determining generic jurisdiction are appropriate for cases of challenging higher-level collective agreements, but are completely unacceptable for cases of direct judicial review over local-level collective agreements and local regulations. The most appropriate criterion for generic jurisdiction in cases of challenging local-level collective agreements and local regulations is the legal basis of the claim. The article substantiates the need to establish a single rule of territorial jurisdiction for cases of direct judicial review over specific labour law sources – at the place of residence or address of the subject who formed the disputed source of law on the part of the employer.
